Orders
An order is an offer to buy. It becomes a contract when we email you a dispatch confirmation. We may decline an order if a piece is out of stock, if the price was listed in error, or if we cannot ship to your address.
Pricing
Prices are in US dollars and exclude sales tax where applicable and any import duty. If a price is obviously wrong we will contact you before charging anything.
Delivery and risk
Risk passes to you when the carrier delivers the parcel. Delivery estimates are estimates — a carrier delay is not a breach of these terms, but we will help you chase it.
Returns
Thirty days on unworn pieces with tags attached, as set out on the shipping & returns page, which forms part of these terms.
Intellectual property
All graphics, photographs, patterns and text on this site belong to Gifted Elite New York unless credited otherwise. You may not reproduce our artwork on garments, print or merchandise without written permission.
Acceptable use
- Do not scrape, mirror or resell this site's content
- Do not attempt to interfere with the site's operation or security
- Do not buy with the intention of reselling as authorised stock
Liability
We are responsible for loss you suffer as a foreseeable result of us breaking this contract. We are not liable for indirect or consequential loss. Nothing here limits liability for death, personal injury or fraud.
Governing law
These terms are governed by the laws of the State of New York, and disputes are subject to the exclusive jurisdiction of its courts.
